Nestlé USA Consumer Privacy Policy

This Privacy Policy (or “Policy”) tells you how Nestlé USA (“Nestlé USA,” “we,” or “our”) collects, uses, shares, and protects information about our consumers (“you”). It also tells you how you can access and update your information and make certain choices about how your information is used. This Policy covers both our online and offline data collection activities, including information that we may collect through our various websites and applications and offline programs and events. By using a Nestlé USA website or application or by otherwise giving us your information, you agree to this Privacy Policy. If you do not agree to this Policy, you must not use our website or application or give us any of your information.

If we change the way we handle your information, we will update this Privacy Policy. For material changes (substantially new practices you wouldn’t expect from us or that we didn’t previously tell you about), we will provide a prominent notice at the site or email you at the address you have provided prior to the change becoming effective. 1. What does this Privacy Policy apply to?

This Privacy Policy applies to information that we, Nestlé USA, collect from or about our consumers through the methods described below. This Policy does NOT apply to information collected by our parent company, affiliate companies, or joint venture partners.

Please note we may combine information that we collect via one method (e.g., a Nestlé USA website) with information that we collect via another method (e.g., a Nestlé USA offline event). We do this to get a more complete view of our consumers, which, in turn, allows us to serve you better and with more customization.

Nestlé USA websites

This refers to any consumer-directed websites operated by Nestlé USA, including sites that we operate under our own domains/URLs and sites that we run on third party social networks such as Facebook. This Policy will only apply to the Nestlé USA site if it provides a direct link to this page.

2. What information do we collect?

Depending on how you interact with Nestlé USA (online, offline, over the phone, etc.), we may collect from you various types of information, as described below. In some instances (and unless we say otherwise below), we may combine one type of information with another type of information, and store them together in our records. We strive to limit the amount of information we collect and store to that which is reasonably necessary to provide you the relevant services. We generally store your information for as long as your account is active with us or as needed to provide you the relevant services. Personal contact info

This includes any information that would allow us to personally contact you, such as your name, home or mailing address, phone number (home, cell, etc.), or email address. You can always opt-out from receiving marketing-related email communications or text messages by following the unsubscribe instructions provided in each such communication. If you have an account with us, you may be given the option to change your communication preferences under the relevant edit-account section of our site (if available) or by contacting Consumer Services. Please note that even if you opt out from receiving marketing communications, you may still receive administrative communications from us, such as order confirmations, notifications about your account activities (e.g., account confirmations, password changes, etc.), and other important announcements.

Also, please note that if you participated in a promotion that involved a third party company, and, as part of that promotion, you agreed to receive future marketing communications directly from that third party, you will need to contact the third party (not Nestlé USA) to opt-out from such communications. Third party social networking

We may collect and use your information when you interact with third party social networking features such as “Facebook Connect” or “Facebook Like”. We may request and use your information so you can use website viral features, such as our tell-a-friend features. These features typically require the collection and use of personal contact information (such as names and email addresses) so that the selected one-time message or content can be delivered to the proper recipients. In most cases, we do not retain the information provided. In some cases (for example, as part of a refer-a-friend program), we may store the information so we can track and reward consumers for their successful referrals. Order fulfillment

Secure operating environments

We store your information in secure operating environments that are protected from the public and that we only allow authorized Nestlé USA employees and agents/contractors to access on a need-to-know basis. We follow generally accepted industry standards to protect personal information; however, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security.

We use industry-standard encryption to provide greater protection for sensitive financial information, such as credit card information, sent to us over the web. For example, encryption is used when you make payments through our online stores. A. Nestlé takes all necessary measures to keep your personal information private and secure. Only authorized Nestlé Group staff, Third Party (Non Nestlé Group) companies (i.e. service providers) staff or our business partners' authorized staff (who have contractually agreed to keep all information secure) have access to your personal information. All Nestlé staff are required to adhere to the Nestlé Group Privacy Policy and all relevant third-party employees have signed privacy and non-disclosure agreements. In addition, contracts are in place with third-party companies that have access to your personal information, to make sure this information remains secure. To ensure your personal information is protected, Nestlé maintains a secure IT environment and has the appropriate measures in place to prevent unauthorized access (i.e. hacking).

A. Nestlé will never share your personal information with any Third Party (Non Nestlé Group) business organization that intends to use it for direct marketing purposes unless you have given us specific permission to do this.

Q. 6 Which countries will your personal information be sent to and why?

A. Nestlé Canada Inc. is part of the Nestlé global company. The server that makes this Web site available is located outside the country from which you have accessed this Web site. Our main hosting provider for most Nestlé Web sites is based in the United States. This provider is bound by a contract that ensures a high standard of privacy protection and requires (amongst other provisions) that it act only on Nestlé instructions and implements all technical measures necessary on an ongoing basis to keep your personal information secure.

Q. 7 COOKIES ("Tracking Technology") - How and why does Nestlé use them?

A. Nestlé does make use of tracking technology ('Cookies') to gather such personal information as browser type and operating system, referring page, path through site, domain of ISP etc. for the purpose of understanding how visitors use this Web site. Cookies help us tailor this website to your personal needs.

Nestlé keeps all the information collected from cookies in a non-personally identifiable format. This type of information obtained through cookies will not be disclosed outside the Nestlé Group or designated Third Parties. It will not be used for unsolicited communications.

Cookies located on your computer do not contain your name but an IP address. After the user's session is cancelled the information contained in the cookies is no longer available to Nestlé.

Q. 8 E Marketing - What is SPAMMING and what is Nestlé's position on SPAM e-mails?

A. Spamming is where unsolicited e-mails are sent to you containing advertisements or marketing related materials without your consent.

Nestlé does NOT send SPAM e-mails. Nestlé itself uses an anti-SPAM tool to protect our employees from SPAMMING. Sending e-mails without consent is illegal in many countries. Nestlé will not use your personal information (including your e-mail address) for direct marketing or follow-up communications unless you give us your EXPRESS permission. This is called "OPT-IN" consent.

Also, Nestlé does not share your personal information with any Third Party (non-Nestlé Group) companies who will use your personal information for SPAM mails.

Nestlé Web sites give you the opportunity to receive marketing information by e-mail. Every e-mail sent by Nestlé will give you the opportunity at any time to stop receiving marketing e-mails.

Q. 9 For how long does Nestlé keep your personal information?

A. Nestlé may store the personal information that you send to us via this website in its databases such as its Customer Relationship Marketing database. Your personal information will be kept by the Nestlé Group only for as long as is reasonably necessary taking into consideration our need to answer queries or resolve problems, provide improved and new services and comply with legal requirements under applicable law(s). This means that we may retain your personal information for a reasonable period after you stop using Nestlé services or stop using this Web site. After this period, your personal information will be deleted from all systems in the Nestlé Group.

Q. 10 What is Nestlé's policy on children using and communicating with our websites?

A. We believe that it is highly important to protect the privacy of children on-line and encourage parents or guardians to spend time on-line with their children to participate in and monitor their e-activities.

We do not intentionally collect personal information from children under the age of 13 except on some of our children's Web sites. On these Web sites, we will collect such personal information in accordance with all local laws and regulations applicable to the privacy rights of children. If parents or guardians provide consent for the child to submit personal information, we will ask children only for the personal information necessary to participate in the program for which the child is registering.

Q. 17 Which terms have specific legal meanings in this Nestlé Privacy Notice (they are highlighted for your ease of use with Capital Letters excepting personal information simply because it is mentioned so often!)?

A. Personal Information can also be known as Personal Data and means any information relating to you as a natural person that is capable of directly identifying you. (On Web sites this is typically at least your e-mail address). This may include, but is not limited to, your name, address, home telephone number, age and consumer preference information.

Processing of Personal Information means any operation or set of operations which is performed upon your personal information whether or not by automatic means including collection, recording, organization, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, blocking, erasure or destruction (i.e. effectively any activity that Nestlé performs on or with the personal information that you send us).
